{"id":357752,"date":"2024-07-25T09:17:28","date_gmt":"2024-07-25T13:17:28","guid":{"rendered":"https:\/\/skiesmag.com\/?post_type=news&#038;p=357752"},"modified":"2024-07-25T09:17:29","modified_gmt":"2024-07-25T13:17:29","slug":"us-files-details-of-boeings-plea-deal-related-to-plane-crashes","status":"publish","type":"news","link":"https:\/\/skiesmag.com\/news\/us-files-details-of-boeings-plea-deal-related-to-plane-crashes\/","title":{"rendered":"US files details of Boeing\u2019s plea deal related to plane crashes"},"content":{"rendered":"\n<p>The Justice Department submitted an agreement with&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/hub\/boeing-co\">Boeing<\/a>&nbsp;on Wednesday in which the aerospace giant will plead guilty to a fraud charge for misleading U.S. regulators who approved the&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-plea-737-max-crashes-b34daa014406657e720bec4a990dccf6\">737 Max jetliner<\/a>&nbsp;before two of the planes crashed, killing 346 people.<\/p>\n\n\n\n<p>The detailed plea agreement was filed in federal district court in Texas. The American company and the Justice Department reached a deal on&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-guilty-plea-crashes-245a38dc6d3082f4ddff1f6f74f274f2\">the guilty plea<\/a>&nbsp;and the agreement&#8217;s broad terms earlier this month.<\/p>\n\n\n\n<p>The final version states&nbsp;Boeing&nbsp;admitted that through its employees, it made an agreement \u201cby dishonest means\u201d to defraud a Federal Aviation Administration group that evaluated the 737 Max. Because of Boeing\u2019s deception, the FAA had \u201cincomplete and inaccurate information\u201d about the plane&#8217;s flight-control software and how much training pilots would need for it, the plea agreement says.<\/p>\n\n\n\n<p>U.S. District Judge Reed O\u2019Connor can accept the agreement and the sentence worked out between&nbsp;Boeing&nbsp;and prosecutors, or he could reject it, which likely would lead to new negotiations between the company and the Justice Department.<\/p>\n\n\n\n<p>The deal calls for the appointment of an independent compliance monitor, three years of probation and a fine of at least $243.6 million. It also requires&nbsp;Boeing&nbsp;to invest at least $455 million \u201cin its compliance, quality, and safety programs.\u201d<\/p>\n\n\n\n<p>Boeing&nbsp;issued a statement saying the company \u201cwill continue to work transparently with our regulators as we take significant actions across&nbsp;Boeing&nbsp;to further strengthen&#8221; those programs.<\/p>\n\n\n\n<p>Paul Cassell, a lawyer for families of victims of the 737 Max crashes who wanted&nbsp;Boeing&nbsp;to face trial, criticized the agreement.<\/p>\n\n\n\n<p>\u201cThe plea has all the problems in it that the families feared it would have. We will file a strong objection to the preferential and sweetheart treatment&nbsp;Boeing&nbsp;is receiving,\u201d he said.<\/p>\n\n\n\n<p>Boeing&nbsp;was accused of misleading the FAA about aspects of the Max before the agency certified the plane for flight.&nbsp;Boeing&nbsp;did not tell airlines and pilots about the new software system, called MCAS, that could turn the plane\u2019s nose down without input from pilots if a sensor detected that the plane might go into an aerodynamic stall.<\/p>\n\n\n\n<p>Max planes crashed in 2018 in Indonesia and 2019 in Ethiopia after a faulty reading from the sensor pushed the nose down and pilots were unable to regain control. After the second crash, Max jets were grounded worldwide until the company redesigned MCAS to make it less powerful and to use signals from two sensors, not just one.<\/p>\n\n\n\n<p>Boeing&nbsp;avoided prosecution in 2021 by reaching a&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/business-indonesia-61b2ccb06d4eebb2d4091c6d90147f72\">$2.5 billion settlement<\/a>&nbsp;with the Justice Department that included a previous $243.6 million fine. It appeared that the fraud charge would be permanently dismissed until January, when a panel covering an unused exit blew off a 737 Max during an Alaska Airlines flight. That&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-sales-cancellations-crisis-674375bc711c299cac19b6df09443d4a\">led to new scrutiny<\/a>&nbsp;of the company\u2019s safety.<\/p>\n\n\n\n<p>In May of this year, prosecutors said&nbsp;Boeing&nbsp;violated&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-justice-department-737-max-82145b25ed988cd8cae0bce3de79ce9d\">terms of the 2021 agreement<\/a>&nbsp;by failing to make promised changes to detect and prevent violations of federal anti-fraud laws.&nbsp;Boeing&nbsp;agreed this month to plead guilty to the felony fraud charge instead of enduring a potentially lengthy public trial.<\/p>\n\n\n\n<p>The role and&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-plea-agreement-corporate-crime-41eb045ec7a3a3d85be3a7fdcf0810b8\">authority of the monitor<\/a>&nbsp;is viewed as a key provision of the new plea deal, according to experts in corporate governance and white-collar crime. Cassell has said that families of the crash victims should have the right to propose a monitor for the judge to appoint. The agreement calls for the government to select the monitor \u201cwith feedback from&nbsp;Boeing.\u201d<\/p>\n\n\n\n<p>In Wednesday&#8217;s filing, the Justice Department said that&nbsp;Boeing&nbsp;\u201ctook considerable steps\u201d to improve its anti-fraud compliance program since 2021, but the changes \u201chave not been fully implemented or tested to demonstrate that they would prevent and detect similar misconduct in the future.\u201d<\/p>\n\n\n\n<p>That\u2019s where the independent monitor will come in, \u201cto reduce the risk of misconduct,\u201d the plea deal states.<\/p>\n\n\n\n<p>Boeing, which is based in Arlington, Virginia, is a major Pentagon and NASA contractor, and a guilty plea is not expected to change that. Government agencies have leeway to hire companies even after a criminal conviction. The plea agreement does not address the topic.<\/p>\n\n\n\n<p>Some of the&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-plane-crashes-737-max-justice-department-da2977c487811e873be2d118b3c5e529\">passengers\u2019 relatives<\/a>&nbsp;plan to&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-justice-department-fraud-charge-prosecution-12b3661b9d86623f2774cb3a84a7fc68\">ask the judge to reject<\/a>&nbsp;the plea deal. They want a full trial, a harsher penalty for&nbsp;Boeing, and many of them want current and former&nbsp;Boeing&nbsp;executives to be charged.<\/p>\n\n\n\n<p>If the judge approves the deal, it would apply to the criminal charge stemming from the 737 Max crashes. It would not resolve other matters, potentially including litigation related to the&nbsp;<a target=\"_blank\" href=\"https:\/\/apnews.com\/article\/boeing-ntsb-alaska-airlines-737-max-89e5655184516b4c54a9378414fe4cea\">Alaska Airlines blowout<\/a>.<\/p>\n\n\n\n<p>Boeing&nbsp;could appeal any order the court imposes to pay restitution to victims&#8217; families \u2014 the agreement leaves restitution up to the judge.
